By accessing or using PageGenius ("the App," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use PageGenius. These Terms constitute a legally binding agreement under U.S. contract law between you ("User") and PageGenius ("we," "us," "our").
PageGenius reserves the right to modify these Terms at any time. Continued use of the Service following any modification constitutes acceptance of the updated Terms.
PageGenius is designed exclusively for personal, non-commercial educational use. Features including OCR text extraction, summarization, flashcard generation, translation, transcription, practice test creation, and audiobook generation are intended solely to assist individual users in studying and learning.
You may not use PageGenius to reproduce, distribute, publicly display, sell, sublicense, or otherwise exploit any materials — whether your own or third-party — beyond lawful personal study. Misuse of AI-generated content derived from copyrighted materials may expose you to civil and criminal liability under 17 U.S.C. § 106.
PageGenius does not claim ownership of any content you upload. You retain all rights, title, and interest in materials you submit to the Service. By uploading content, you grant PageGenius a limited, non-exclusive, royalty-free license solely to process and deliver the Service features to you.
Your scanned files and generated study materials (flashcards, tests, summaries, and your library) are stored locally on your own device, in your browser's local storage — not in a centralized PageGenius database. PageGenius does not host, index, back up, or maintain a copy of your library content on its servers. If you clear your browser's data or switch devices, that locally stored content will not be recoverable by PageGenius.
During AI processing (for example, running OCR on a scan or generating a summary), your file content is transmitted securely to our backend and to the third-party AI provider solely to fulfill that specific request. It is not retained by PageGenius or used to train AI models after the request completes. See our Privacy Policy for full details on data handling.
This app does not distribute, share, or make your content accessible to any other user or third party.
By using PageGenius, you expressly agree that you will NOT:

PageGenius's AI features are designed to facilitate uses that may qualify as fair use under 17 U.S.C. § 107, including comment, criticism, teaching, scholarship, and research. Fair use is determined on a case-by-case basis and is not guaranteed. The four statutory factors — (1) purpose and character of use, (2) nature of the copyrighted work, (3) amount used, and (4) market effect — apply to every use of third-party materials.
PageGenius does not provide legal advice. Users are solely responsible for ensuring their use of uploaded materials complies with applicable law.
PageGenius, its developers, affiliates, officers, employees, and its parent company are not responsible for any copyright, intellectual property, privacy, or legal violations arising from how the end user captures or uses content.
The end user is solely responsible for ensuring they have the legal right to record, photograph, scan, or transcribe any material — including but not limited to lectures, meetings, books, articles, proprietary content, classroom materials, or any other third-party works.
By creating an account and using PageGenius, the user accepts full legal responsibility for the legality of their own files and data. PageGenius and its parent company cannot be held liable for any user-generated content or its use.
You agree to indemnify, defend, and hold harmless PageGenius, its developers, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
PageGenius complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content accessible through PageGenius infringes your copyright, you may submit a written DMCA notice to our designated agent containing: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy under penalty of perjury; and (6) your physical or electronic signature.

Repeat infringers will have their accounts terminated in accordance with 17 U.S.C. § 512(i).
PageGenius handles personal data in compliance with applicable U.S. privacy law, including the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g, where applicable, and the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506. PageGenius is not directed to children under 13. If you are under 13, you may not use the Service.
Uploaded materials processed by AI features are not used to train AI models or shared with third parties except as required to deliver the Service. PageGenius's data practices are further governed by our Privacy Policy, which is incorporated into these Terms by reference.
You agree not to use PageGenius to:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAGEGENIUS DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL PAGEGENIUS, ITS DEVELOPERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF PAGEGENIUS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH PAGEGENIUS IS TO DISCONTINUE USE OF THE SERVICE. IN NO EVENT SHALL PAGEGENIUS'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO PAGEGENIUS, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
These Terms are governed by and construed in accordance with the laws of the United States of America and the state in which PageGenius is incorporated, without regard to conflict of law principles.
Any dispute arising from these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, except where prohibited by law. You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.
Nothing in this section limits your rights to file a complaint with the FTC (15 U.S.C. § 45) or other applicable regulatory bodies.
PageGenius reserves the right to suspend or terminate any account, at any time, with or without notice, for any violation of these Terms, including but not limited to: unauthorized distribution of content, copyright infringement, or any conduct that undermines the integrity of the Service.
Upon termination, your right to use the Service ceases immediately. Any data associated with your account may be permanently deleted. No refunds will be issued for terminated accounts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PageGenius regarding your use of the Service.
